Odisha government has revised Right of Children to Free & Compulsory Education Rules, mandating annual exams & re-exams for Classes 5 & 8, with provisions to retain students who fail both attempts

The Government of Odisha has made amendments to the Odisha Right of Children to Free and Compulsory Education Rules, 2010, to implement the decision. The Odisha government has established a fail system for the annual examinations of Class 5 and 8 starting from the current academic year, according to an official notification.
According to the notification, a regular examination for Classes 5 and 8 will take place after each academic year. If a child does not pass the examination, he/she will receive additional instruction and will be allowed to re-take the examination within two months from the date the results are announced. To facilitate this decision, the government enacted necessary amendments to the Odisha Right of Children to Free and Compulsory Education Rules, 2010 on Wednesday.
As stated in a notification released by the state School and Mass Education Department, a regular examination for Class 5 and 8 will be conducted at the end of each academic year. If a child fails the examination, he/she will be provided with additional instruction and will have the chance for re-examination within two months from the announcement of the results, as indicated in the notification.
“If the child who takes the re-examination fails to meet the promotion criteria once more, he/she will be retained in either the fifth or eighth class, depending on the situation,” the notification stated. However, it also mentioned that no child will be expelled from any school until they have completed their elementary education, as per the order.
In December of the previous year, the Government of India amended the Right of Children to Free and Compulsory Education Act 2010 (RTE Act 2010). These amendments permit states to conduct regular examinations for students in classes 5 and 8 and to retain them if they do not pass. These changes were made five years after the RTE Act was revised in 2019.
