In a landmark move to ensure technology serves rather than subverts justice, UNESCO has released the first-ever global guidelines for the use of Artificial Intelligence in judicial systems, establishing 15 universal principles to protect the rule of law

As courtrooms worldwide increasingly turn to digital tools to manage overwhelming caseloads, the United Nations Educational, Scientific and Cultural Organization (UNESCO) has stepped in to draw a red line between administrative efficiency and judicial integrity. Released this week, the “Guidelines for the Use of AI Systems in Courts and Tribunals” represent the first global ethical framework designed to govern the rapid integration of artificial intelligence into the justice sector.
The initiative comes at a critical juncture. With legal systems facing massive backlogs—some countries reporting millions of pending cases—and the seductive efficiency of generative AI tools like ChatGPT, the risk of “automated injustice” has never been higher. From AI “hallucinations” citing non-existent case law to algorithmic biases that could disadvantage vulnerable populations, the need for guardrails is urgent.
“Artificial Intelligence is transforming justice systems worldwide, offering new possibilities to improve access to justice, streamline case management, and assist judicial decision-making,” the report states. “Yet, these innovations also bring complex ethical and human rights challenges.”
The Context: From Efficiency to Ethics
The digital transformation of the judiciary is no longer a futuristic concept; it is a present reality. In Argentina, AI tools have reportedly increased case processing efficiency by nearly 300%. In India and Egypt, automated translation and transcription are breaking down language barriers in real-time.
However, this speed comes with perils. UNESCO’s report highlights incidents where lawyers and self-represented litigants have unwittingly submitted legal briefs filled with fictitious case citations generated by Large Language Models (LLMs). Furthermore, the use of “black box” algorithms for recidivism risk assessment raises profound questions about transparency and the right to a fair trial.
Addressing these risks, the Guidelines were developed through an extensive consultation process involving over 36,000 judicial actors from more than 160 countries. They are built on a central premise: AI must be an assistive tool, not a substitute for human judgment.
“The judiciary should aim to use AI tools to enhance, rather than replace, human judgment,” the Guidelines emphasize. “AI tools are not a substitute for qualified legal reasoning, human judgment, or tailored legal advice.”
The 15 Universal Principles for AI in the Judiciary
At the heart of the new framework are fifteen universal principles intended to guide courts, judges, and policymakers. These principles serve as a checklist for any judicial body considering the adoption of AI technologies.
1. Protection of Human Rights: The primary obligation of any AI system in court is to respect, protect, and promote human rights. This includes specific safeguards for the rights of women, children, minorities, and persons with disabilities. The Guidelines stress that efficiency cannot come at the cost of fundamental freedoms.
2. Non-Discrimination and Equality: AI systems must not reproduce or reinforce existing biases. Courts must ensure that the data used to train these systems is representative and that the outputs do not disadvantage individuals based on race, gender, or economic status. This also includes ensuring “equality of arms,” where access to advanced AI tools does not give one party an unfair advantage over another who lacks digital resources.
3. Procedural Fairness: The use of AI must not compromise the right to a fair trial. This implies that no individual should be judged solely by a machine, and procedural rights must be maintained even when digital tools mediate the process.
4. Right to Privacy and Data Protection: Given the sensitive nature of legal data, the Guidelines mandate robust data governance. Courts must ensure that AI tools do not become vectors for data breaches or unauthorized surveillance.
5. Liberty and Security: A critical principle for criminal justice: no individual should be detained based on an opaque AI decision. If an AI system influences a decision on bail or parole, the process must be transparent, and the individual must be able to challenge it.
6. Proportionality: The use of AI must be proportional to the aim it seeks to achieve. Courts should not deploy invasive surveillance or predictive tools if less intrusive methods can achieve the same legitimate legal end.
7. Feasibility of Benefits: Before spending public funds on expensive tech, courts must conduct a realistic assessment. Does the AI actually solve a problem? The Guidelines warn against “technological solutionism”—adopting AI just for the sake of novelty without proven benefits for the public or the judiciary.
8. Safety: AI systems must be safe and secure. This involves rigorous testing to ensure they do not cause unintended harm to parties, judges, or the reputation of the judiciary.
9. Information Security: Courts must protect against cyber threats. As justice systems digitize, they become targets for cyberattacks that could manipulate evidence or court records. AI systems must be resilient against such vulnerabilities.
10. Accuracy and Reliability: AI tools used in court must be technically accurate. This is particularly crucial for generative AI, which is prone to errors. The Guidelines define reliable systems as those that work “properly with a range of inputs and in a range of situations.”
11. Explainability: The “Black Box” problem is addressed head-on. Decisions assisted by AI must be explainable. A judge must be able to understand—and explain to the litigant—how an AI tool reached a specific conclusion or recommendation. If the rationale cannot be explained, the tool should not be used for substantive decision-making.
12. Auditability: Transparency requires that AI systems be open to audit. This includes the ability for external experts to examine the system’s code, training data, and outputs to verify that it is functioning as intended and without bias.
13. Transparency and Open Justice: Courts must be transparent about when and how they are using AI. “Inform in a proper and timely manner when and how AI systems are deployed,” the Guidelines advise. The public has a right to know if a machine is assisting in the administration of their justice.
14. Human Oversight and Decision-Making: Perhaps the most critical principle: Humans must remain in the loop. Judges cannot delegate their core mandate to an algorithm. “Judges and magistrates should not delegate any part of their mandate or rely exclusively on AI systems to adopt decisions,” the document states.
15. Multi-stakeholder Governance: The development of AI for courts should not happen in a silo. It requires collaboration between technologists, legal scholars, civil society, and the communities affected by these systems to ensure the technology is trustworthy and inclusive.
Operational Guidance: “Trust but Verify”
Beyond high-level principles, the UNESCO report offers practical “dos and don’ts” for judges using generative AI (like ChatGPT or CoPilot).
The Guidelines are explicit about the limitations of current technology. They warn that “commercial general-purpose LLMs are not reliable sources of information or adequate means for conducting legal analysis.”
Key operational recommendations include:
- Do not input confidential data: Public chatbots often use input data to train future models. Judges are warned never to paste sensitive case details into open AI tools.
- Verify every output: The “convincing structure” of AI-generated text can be misleading. Every citation, fact, and legal argument produced by AI must be cross-checked with reliable legal sources.
- Declare the use of AI: If a judge uses AI to help draft a ruling or summary, this should be disclosed. Transparency is vital to maintaining public trust.
A Living Document for an Evolving Threat
UNESCO acknowledges that technology evolves faster than regulation. As such, these Guidelines are described as a “living document,” intended to be updated as new capabilities—and new risks—emerge.
The report concludes with a powerful reminder of the human element in law: “Since wars begin in the minds of men and women, it is in the minds of men and women that the defenses of peace must be constructed.” In the context of the judiciary, this means that while AI can process data, only the human mind can truly process justice.
As courts around the world begin to adopt these standards, the hope is that efficiency will no longer come at the expense of equity, ensuring that the gavel remains firmly in human hands.
